This Risk Disclosure describes the main risks of exchanging cryptocurrencies through MoinCash. It is not exhaustive, and it is not investment, legal or tax advice. Please read it carefully before creating an order. If you do not understand a risk described here, do not proceed.
1. Market volatility The value of digital assets can change substantially and rapidly, including within the few minutes an exchange takes to complete. Prices are set by open markets and can be affected by liquidity, sentiment, technical events, regulatory announcements and factors that cannot be anticipated. The value of the asset you receive may fall below the value of the asset you sent, at any time after the exchange. You may lose part or all of the value of your assets, and you should only exchange amounts you can afford to put at risk.
2. Floating-rate risk For a floating-rate exchange, the final amount is determined when your deposit is confirmed on the network, not when the quote is displayed. The amount shown when you create the order is an estimate. If the market moves against you while your deposit is being confirmed, you will receive less than the estimate, and the difference can be significant during volatile periods. There is no upper or lower bound on this difference other than the market itself.
3. Fixed-rate expiry and payment conditions A fixed-rate quote is locked only until the expiry time shown, and only for the exact amount stated, on the network stated. If your payment arrives after expiry, in a different amount, in a different asset, or on a different network, the locked rate no longer applies. In that case the deposit is handled under the rules of the service provider concerned and may be exchanged at the rate applicable when it is processed, returned to your refund address after deduction of network costs, or held for manual review. Wallet queues, low network fees and exchange withdrawal delays are common reasons why payments arrive late, and they are outside our control.
4. Network congestion and confirmation delays Exchanges depend on public blockchain networks. Congestion, low gas settings, validator or miner behaviour, chain reorganisations, outages and scheduled upgrades can all delay a deposit, the required confirmations, or the outgoing payment. Estimated processing times displayed on the platform are indicative only. A delay caused by a network cannot be reversed or accelerated by us, and a delay may in itself expose you to price movement.
5. Irreversibility of blockchain transactions Once a blockchain transaction has been broadcast, it cannot be cancelled, recalled or reversed by anyone, including us and the service providers. There is no chargeback mechanism comparable to that of a card payment or a bank transfer. You must be certain of every detail before you send funds.
6. Wrong address, wrong network and missing memo or tag You are responsible for the receiving address, the network and any memo or destination tag you supply. Funds sent to an address that you do not control, to an address on a network different from the one selected, to an address that cannot receive the asset concerned, or without a required memo or destination tag are generally unrecoverable. Addresses that look similar, clipboard-hijacking malware and copied addresses from an old order are frequent causes of loss. Always verify the full address and the network before confirming, and where a memo or tag is requested, always include it.
7. Third-party service provider risk Exchanges are executed through third-party liquidity and exchange service providers, and deposit addresses may be provided by them. A provider may delay processing, change its rules or limits, apply its own compliance checks, request additional information, or suspend or discontinue a route. In rare cases a provider may suffer an outage, a security incident or insolvency. Such events are outside our control, and while we will assist you in pursuing a resolution, we cannot guarantee the recovery, exchange or return of funds affected by them.
8. Liquidity and route availability Not every pair of assets is supported at all times, and each route has a minimum and a maximum amount. Rates, limits and availability depend on market conditions and on our providers, and they can change at any time and without notice. A route that was available when you planned an exchange may be unavailable, or priced differently, when you return to it. Large amounts may receive a less favourable rate than smaller ones.
9. Regulatory and compliance risk The regulation of digital assets differs between countries and is still developing. Rules that apply to you, to us or to our providers may change, sometimes at short notice, and may restrict or prohibit certain exchanges, assets or regions. Identity verification may be required for an account or for transactions at or above certain amounts, and sanctions and restricted-region screening is applied. A transaction may be refused, delayed, frozen or reported where the law requires it, or where fraud or money laundering is suspected, and we may be required to request information about the source of your funds. Some capabilities are unavailable in certain regions; our Restricted Regions page indicates where.
10. Tax risk Exchanging one digital asset for another may be a taxable event where you live, even if you never convert to a traditional currency. You are solely responsible for determining, declaring and paying any tax that applies to your activity, and for keeping the records that your tax authority requires. We do not provide tax advice and do not calculate, withhold or report tax on your behalf unless required by law.
11. Technical and security risk Wallet software, browsers, devices, hardware wallets and internet connections can fail, contain bugs, or be compromised. Phishing sites, fake support accounts, malicious browser extensions and social-engineering attacks target users of exchange services; always check that you are on www.moin.cash and never share a password, recovery data, private key or seed phrase with anyone, including anyone claiming to represent us. If you lose access to your wallet, your keys or your recovery data, the assets in that wallet cannot be restored by us. Guest orders are tracked by a credential stored in your browser; if you clear that storage and did not provide an e-mail address, you may be unable to locate the order in the interface. Where you use API keys, anyone who obtains a key can act with it, and you are responsible for that activity.
12. Blockchain forks, upgrades and asset-specific risk Networks may fork, be upgraded, change their consensus rules, migrate to a new contract or token standard, or be abandoned by their developers. Individual assets may lose support, lose liquidity, be delisted by providers, or become worthless. Smart contract assets may contain flaws, may be subject to freezing or blacklisting by their issuers, and may behave differently from what their documentation states. Support for an asset on our platform is not an endorsement of it, nor any statement about its quality, safety or prospects.
13. No investment advice and no protection scheme We provide a technology platform for executing exchanges. Nothing on the platform, in our communications or in our materials is investment, financial, legal or tax advice, or a recommendation to acquire, hold or dispose of any asset. Digital assets are not deposits, are not money, and are not covered by deposit insurance, investor compensation or any similar protection scheme. We do not hold your assets in custody in this flow: funds move from your wallet, through the execution of the exchange, to the receiving address you provide.
14. Your confirmation By creating an order you confirm that you have read and understood this Risk Disclosure, that you accept the risks described in it, that you are exchanging your own assets on your own responsibility, and that you are acting in compliance with the laws applicable to you. If you have any doubt about the suitability of an exchange for your circumstances, seek independent professional advice before proceeding. Questions may be sent to support@moin.cash.
