These Terms of Service ("Terms") govern your access to and use of the MoinCash platform at www.moin.cash, including the website, the exchange interface, any user account, and the merchant API (together, the "Service"). Please read them carefully: they explain how exchanges are executed, the limits of our responsibility, and the risks you accept.
1. Acceptance of these Terms By accessing the Service, creating a quote, placing an order, registering an account, or using an API key, you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy and our Risk Disclosure, which form part of this agreement. If you do not agree, you must not use the Service. If you use the Service on behalf of a legal entity, you represent that you are authorised to bind it, and "you" means both you and that entity.
2. Definitions - "MoinCash", "we", "us" and "our" mean the operating entity of the MoinCash platform, as identified on the platform. - "Service provider" means a third-party liquidity or exchange service provider through which an exchange is executed. - "Quote" means the pricing information presented for a specific exchange, including the rate type, the total fee percentage, the applicable limits and the validity period. - "Order" means an exchange instruction created by you on the basis of a quote. - "Deposit address" means the address to which you send the source asset for an order; it may be provided by a service provider. - "Receiving address" means the address, and where applicable the memo or destination tag, that you supply to receive the target asset. - "Refund address" means the address you supply for the return of the source asset if an exchange cannot be completed. - "Route" means a supported combination of source asset, target asset and the networks on which they are sent and received.
3. Eligibility To use the Service you must be at least 18 years old and have full legal capacity to enter into a binding contract. You must not be located or resident in a region in which the relevant capability is unavailable, as set out on our Restricted Regions page. You must not be subject to economic or trade sanctions, or owned or controlled by, or acting on behalf of, a sanctioned person or entity. You are responsible for ensuring that your use of the Service is lawful where you are, and we may verify your eligibility at any time and refuse or discontinue service if these conditions are not met.
4. Accounts, guest orders and security You may use the exchange flow as a guest, without registering. Guest orders are associated with a credential stored in your browser and can also be recovered by e-mail if you provide one when creating the order. If you clear your browser storage or switch device and have given no e-mail address, you may be unable to retrieve the order in the interface; the order itself is unaffected. A registered account provides order history, a saved address book and, where enabled, API keys.
You are responsible for the confidentiality of your account credentials, for enabling and safeguarding any additional authentication factor offered, and for all activity under your account. Where API keys are issued, the key holder is responsible for all activity carried out with the key, including instructions submitted by anyone else who obtains it. Keep API keys secret and revoke them immediately if you suspect exposure. You must notify us without undue delay at support@moin.cash if you become aware of any unauthorised use of your account or keys.
5. The Service and our role MoinCash is a technology platform that enables cryptocurrency-to-cryptocurrency exchanges. We do not act as your broker, adviser, bank or custodian in this flow, and we do not hold customer balances for it. Exchanges are executed through third-party service providers, and deposit addresses may be provided by them. When you create an order, you are given a deposit address and an exact amount; you send the source asset from your own wallet; after the required network confirmations the exchange is executed; and the target asset is sent to the receiving address you supplied.
Nothing on the Service constitutes investment, financial, legal or tax advice, or a recommendation to acquire, hold or dispose of any digital asset; all decisions are yours alone. We do not operate or control any blockchain network and cannot reverse, cancel or accelerate a transaction once it has been broadcast.
6. Quotes, orders and rate types A quote shows the assets and networks involved, the amount you send, the amount you can expect to receive, the total fee percentage, the applicable limits and the rate type. Two rate types may be offered:
- Fixed rate: the rate is locked until the expiry time shown on the quote. To receive the locked amount you must send the exact amount stated, from the correct network, before expiry. If the deposit is late, short, excessive or otherwise inconsistent with the order, the fixed rate no longer applies and the deposit is handled under section 9. - Floating rate: the final amount is determined when your deposit is confirmed and may be higher or lower than the amount indicated on the quote. The indicated amount is an estimate only and is not guaranteed.
An order is created when you accept a quote and supply the addresses required; if you do not send funds, the order simply expires. Estimated processing times are indicative and depend on network conditions and on the service provider.
7. Fees, pricing, limits and network costs The fee shown on the quote is the total percentage applied to the exchange, and it already includes both our platform fee and the nominal fee of the service provider. The amount presented as receivable is the net amount, after this fee. The network (gas) fee you pay to send the deposit is separate, is set by the network and not by us, and is borne by you. If such costs reduce what you send, only the amount that actually arrives is exchanged.
Each route has a minimum and a maximum amount. If the amount you request falls outside those limits, the request is rejected before an order is created. Limits, rates, fees and route availability reflect market and provider conditions and may change at any time without notice. Prices can move between the moment a quote is displayed and the moment your deposit is confirmed; for floating-rate orders that movement is passed through to the final amount.
8. Your obligations when paying When you pay an order, you must: - send the exact asset shown on the order, on the exact network shown; - send the exact amount shown, for fixed-rate orders, and do so before the quote expires; - include any memo, destination tag or comment required by the network, where one is requested; - supply a receiving address that you control, that is valid for the target asset and network, and that is able to receive that asset; - supply a valid refund address on the source network where one is requested.
You must verify every address and memo before sending. Do not send funds to an expired order or to an address from a different order. We may require additional information where a deposit originates from a source that cannot be attributed to you.
9. Irreversibility, incorrect deposits and refunds Blockchain transactions are irreversible. Once a transaction is broadcast, neither we nor any service provider can reverse or recall it. If you send funds to a wrong address, on a wrong network, or without a required memo or destination tag, the funds are generally unrecoverable, and any loss is your responsibility.
Deposits that arrive after the quote has expired, in an amount that differs from the order, in a different asset, or on a network other than the one shown, are handled under the rules of the service provider concerned. Depending on those rules and on what is technically possible, such a deposit may be refunded to your refund address less network costs, exchanged at the rate applicable when it is processed, or held for manual review, which may require additional information from you. We will make reasonable efforts to assist, but we cannot guarantee that funds will be recovered, exchanged or returned.
10. Prohibited use You must not use the Service to launder money, finance terrorism or proliferation, evade sanctions or export controls, or handle the proceeds of crime. You must not use the Service in connection with fraud, extortion, ransomware, darknet markets, or any activity unlawful in your jurisdiction or ours; provide false or misleading information, impersonate another person, or use another person's funds or identity documents; misrepresent your location or use a proxy, VPN or similar means to circumvent regional restrictions; or attempt to interfere with the Service, gain unauthorised access to it, scrape, overload or reverse engineer it, introduce malicious code, or exploit pricing or system errors for gain.
11. Compliance, identity verification and sanctions We are subject to anti-money-laundering and counter-terrorist-financing obligations. Identity verification (KYC) or business verification (KYB) may be required for accounts and for transactions at or above certain amounts, and sanctions and restricted-region screening is applied per capability; our Restricted Regions page indicates where a capability is unavailable.
To the extent permitted or required by law, we may refuse a quote or order, delay or suspend processing, freeze funds associated with a transaction, request information on the source of funds or the purpose of a transaction, and report a transaction to the competent authorities. We may be legally prohibited from telling you that a report has been made or from explaining a refusal or delay, and we are not liable for losses arising from steps taken in good faith to meet these obligations.
12. Availability, maintenance and third-party providers The Service is provided on an "as available" basis. We may modify, suspend or discontinue all or part of it, including individual routes or assets, with or without notice, for maintenance, security, legal or commercial reasons. Execution depends on third-party service providers and on public blockchain networks, neither of which we control. We do not guarantee uninterrupted availability, a particular processing time, the availability of any route, or that any particular rate will be obtainable.
13. Intellectual property The Service, including its software, interfaces, text, graphics, logos and trade marks, is owned by us or our licensors. We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use it for its intended purpose. You may not copy, modify, distribute, sell, licence or create derivative works from any part of it, or use our names or marks without our prior written consent.
14. Disclaimers To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express, implied or statutory, including merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted or error-free operation. Rates, estimates, processing times and asset information may be inaccurate, incomplete or out of date. Digital assets are volatile and carry substantial risk; please read our Risk Disclosure.
15. Limitation of liability To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, opportunity, goodwill or data, however arising and whether or not we were advised of the possibility of such loss.
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with a particular exchange is limited to the fees actually paid to us for that exchange or, where no such fee was paid, to the equivalent of USD 100.
We are not liable for losses caused by: failures, congestion, delays, forks, reorganisations or changes of any blockchain network; acts, omissions, insolvency, security incidents or suspension of service by a service provider or other third party; errors made by you, including a wrong address, a wrong network, a missing memo or tag, an incorrect amount, or a payment made after expiry; failures, bugs or compromise of wallet software, exchanges, browsers, devices or internet connections you use; phishing, social engineering, or the loss or theft of your private keys or credentials; market movements, including movements between the display of a quote and the confirmation of a deposit; or events described in section 17. Nothing in these Terms excludes liability that cannot lawfully be excluded.
16. Indemnification You agree to indemnify and hold harmless MoinCash, its affiliates and their officers, employees and agents against any claim, loss, liability, fine or expense, including reasonable legal fees, arising out of your use of the Service, your breach of these Terms or of applicable law, or your infringement of the rights of a third party.
17. Force majeure We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, war, civil unrest, acts of government, changes in law, sanctions, strikes, power or telecommunications failures, outages of internet infrastructure or cloud providers, cyber-attacks, and blockchain network failures, congestion or forks.
18. Suspension and termination We may suspend or terminate your access to the Service and close or restrict your account where we reasonably believe you have breached these Terms or applicable law, where required for legal or compliance reasons, where there is a risk of fraud or security compromise, or where we cease to offer the Service. You may stop using the Service, and request closure of your account, at any time. Termination does not affect executed orders, rights accrued before termination, or provisions that by their nature survive, including sections 9 and 13 to 20.
19. Changes to these Terms We may update these Terms to reflect changes in the Service, in our providers, or in legal requirements. The current version and its date are always published on the platform. Changes take effect when published, and continued use of the Service constitutes acceptance; if you do not accept a change, you must stop using the Service. Changes do not apply retroactively to completed orders.
20. Governing law and dispute resolution These Terms, and any dispute or claim arising out of or in connection with them or with your use of the Service, are governed by the laws of the jurisdiction in which the operating entity of MoinCash is established, as stated on the platform, without regard to conflict-of-law rules.
If a dispute arises, you agree to contact us first at support@moin.cash and to attempt to resolve it in good faith. If it is not resolved within 30 days of your first written notice, it shall be submitted to the competent courts or, where the platform so provides, to arbitration, in the jurisdiction in which the operating entity of MoinCash is established, as stated on the platform. To the extent permitted by law, disputes must be brought individually and not as part of a class or representative action. Mandatory consumer protection rights in your country of residence are not affected.
21. General If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in force and the invalid provision is replaced by a valid one that most closely reflects its intent. Our failure to enforce a right is not a waiver of it. You may not assign your rights or obligations without our prior written consent; we may assign them to an affiliate or successor. These Terms, together with the Privacy Policy, the Risk Disclosure and any additional terms applicable to the merchant API, constitute the entire agreement between you and us regarding the Service and supersede any prior understanding. Where these Terms are published in more than one language and there is a discrepancy, the English version prevails to the extent permitted by law.
22. Contact Questions about these Terms, about an order, or about your account can be sent to support@moin.cash.
